Terms of Service

1. Agreement to Terms

By purchasing or using any DuckSpark software product, including Order Pulse Pro ("the Plugin"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not purchase or use the Plugin.

2. License Grant

Upon purchase, DuckSpark grants you a non-exclusive, non-transferable license to install and use the Plugin on the number of WordPress installations permitted by your plan (Single Site: 1 site; Agency: up to 5 sites; Unlimited: unlimited sites). This license is valid for one year from the date of purchase and renews upon renewal payment.

3. License Restrictions

You may not:

  • Redistribute, resell, sublicense, or transfer the Plugin or license key to any third party.
  • Use the Plugin on more sites than permitted by your plan.
  • Reverse engineer, decompile, or attempt to extract the source code of any compiled portion of the Plugin.
  • Remove or alter any copyright, trademark, or proprietary notices.

4. Payments and Renewals

All payments are processed by Paddle, our authorized Merchant of Record. Paddle handles billing, invoicing, and applicable sales taxes on our behalf. Licenses are annual subscriptions. You will be notified before renewal. Failure to renew will result in loss of updates and support, but the Plugin will continue to function.

5. Updates and Support

An active license entitles you to plugin updates and email support for the duration of the license period. DuckSpark reserves the right to modify or discontinue features with reasonable notice.

6. Disclaimer of Warranties

The Plugin is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. DuckSpark does not warrant that the Plugin will be error-free or uninterrupted.

7. Limitation of Liability

To the maximum extent permitted by law, DuckSpark shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Plugin, even if DuckSpark has been advised of the possibility of such damages. DuckSpark's total liability shall not exceed the amount paid for the Plugin in the twelve months preceding the claim.

8. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved exclusively in the courts located in India.

9. Changes to Terms

DuckSpark reserves the right to update these Terms at any time. Continued use of the Plugin after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email.
